UPDATE: Class Members who submitted a valid Claim Form were sent an email on September 21, 2021, requesting a completed IRS Form W-9. The Internal Revenue Service requires us to provide a Social Security Number (“SSN”) or Taxpayer Identification Number (“TIN”) for every settlement payment that exceeds $600. The payments are expected to be approximately $700. If you did not receive the email, please mail a completed Form W-9 to Rogers v. CSX Settlement Administrator, P.O. Box 2438, Portland, OR 97208-2438. An example of the email can be found under the Documents tab. Checks are expected to mail in November, 2021.

A proposed settlement has been reached in the class action lawsuit, Rogers v. CSX Intermodal Terminals, Inc., No. 2019-CH-04168, currently pending in the Circuit Court of Cook County, Illinois before the Honorable Allen P. Walker. The Settlement would resolve a lawsuit brought on behalf of persons who allege that CSX Intermodal Terminals, Inc. (“CSX” or “Defendant”) required individuals visiting its Illinois facilities between March 29, 2014, and January 29, 2021 to provide their fingerprints in order to enter the facilities without first providing them with legally-required written disclosures and obtaining written consent.

The Court has granted preliminary approval of the Settlement and has conditionally certified the Settlement Class for purposes of settlement only. This website explains the nature of the class action lawsuit, the terms of the Settlement, and the legal rights and obligations of the Settlement Class Members. Please read the information below so that you can better understand your legal rights.

If you are a Class Member, your rights will be affected, and you may be eligible for a payment from the Settlement. You are a member of the Settlement Class if you used the Fingerscan System at a CSX Intermodal facility in Illinois any time between March 29, 2014, and January 29, 2021.

If the Court approves the Settlement, members of the Settlement Class who submit valid claims will receive an equal, or pro rata, share of a $5,250,000.00 Settlement Fund that CSX has agreed to establish. Each individual who submits a valid claim will receive an equal portion of this fund, after all notice and administration costs, the incentive awards, and attorneys’ fees—if approved by the Court—have been paid. The Court in charge of this case still has to decide whether to approve the Settlement. Please be patient.

Your Legal Rights and Options in This Lawsuit:
Submit a Claim To accept the Settlement, you must submit a Claim Form by May 7, 2021. Submitting a valid and timely Claim Form is the only way to receive a payment from this Settlement and is the only thing you need to do to receive a payment. Click here to submit a claim. See FAQ 6a.
Exclude Yourself If you exclude yourself, you will receive no payment from this Settlement, but you will remain free to sue CSX and the other Releasees on your own and at your own expense regarding the claims at issue in this litigation. The deadline for excluding yourself is April 16, 2021. See FAQ 6b.
Object to the Settlement You may file an objection if you wish to object to the Settlement. The deadline to object to the settlement is April 16, 2021. See FAQ 6c.
Do Nothing If you do nothing, you will receive no money from the Settlement, but you will still be bound by all the orders and judgments of the Court and you will still give up your rights to sue CSX and the Releasees as described in FAQ 7 and FAQ 6d.
