A proposed settlement has been reached in the class action lawsuit, Rogers v. CSX Intermodal Terminals, Inc., No. 2019-CH-04168, currently pending in the Circuit Court of Cook County, Illinois before the Honorable Allen P. Walker. The Settlement would resolve a lawsuit brought on behalf of persons who allege that CSX Intermodal Terminals, Inc. (“CSX” or “Defendant”) required individuals visiting its Illinois facilities between March 29, 2014, and January 29, 2021 to provide their fingerprints in order to enter the facilities without first providing them with legally-required written disclosures and obtaining written consent.

The Court has granted preliminary approval of the Settlement and has conditionally certified the Settlement Class for purposes of settlement only. This website explains the nature of the class action lawsuit, the terms of the Settlement, and the legal rights and obligations of the Settlement Class Members. Please read the information below so that you can better understand your legal rights.

If you are a Class Member, your rights will be affected, and you may be eligible for a payment from the Settlement. You are a member of the Settlement Class if you used the Fingerscan System at a CSX Intermodal facility in Illinois any time between March 29, 2014, and January 29, 2021.

If the Court approves the Settlement, members of the Settlement Class who submit valid claims will receive an equal, or pro rata, share of a $5,250,000.00 Settlement Fund that CSX has agreed to establish. Each individual who submits a valid claim will receive an equal portion of this fund, after all notice and administration costs, the incentive awards, and attorneys’ fees—if approved by the Court—have been paid. The Court in charge of this case still has to decide whether to approve the Settlement. Please be patient.

This website explains important legal rights that Settlement Class Members have. These rights and options, and the deadlines to exercise them, are further explained in the Long Form Notice. The Long Form Notice is also available in Spanish. You may also wish to read the Frequently Asked Questions page of this website for additional information. Class Members’ legal rights are affected whether they act or don’t act, so please read the Long Form Notice and this website carefully.
